In these Terms and Conditions, the following terms have the meanings set out below:

"Bunga Setia", "we", "us", "our" refers to Bunga Setia, a legal advisory practice with offices at 33, Jalan Padungan, 93100 Kuching, Sarawak, Malaysia.

"Website" means the website accessible at https://bungaset.club.

"Services" means the family law advisory services provided by Bunga Setia, including Couples Counselling-Adjacent Legal Advisory, Custody Order Enforcement, and Estate-Linked Family Counsel.

"User", "you", "your" refers to any person who accesses or uses the Website or enquires about or engages our Services.

"Engagement Agreement" means a separate written agreement entered into between Bunga Setia and a client setting out the specific terms of a particular advisory engagement.

"Content" means all text, information, and materials published on the Website.

By accessing or using this Website, or by submitting an enquiry through our contact form, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under Malaysian law.

These Terms and Conditions govern your use of the Website and any pre-engagement interactions with Bunga Setia. They do not replace any Engagement Agreement entered into for the provision of Services; in the event of conflict between these Terms and an Engagement Agreement, the Engagement Agreement will prevail.

Bunga Setia provides family law advisory services in Sarawak, Malaysia. Our primary areas of practice are: (a) legal advisory for couples engaged in counselling; (b) representation in custody order enforcement matters; and (c) estate-linked family counsel.

Services are provided from our offices in Kuching, Sarawak. Some elements of advisory work may be conducted remotely by correspondence or remote consultation where appropriate and agreed.

Enquiries submitted through the Website are not an engagement of our Services and do not create a solicitor-client relationship. A solicitor-client relationship is only established upon execution of an Engagement Agreement.

When using this Website or submitting any enquiry, you agree to:

• Provide accurate and truthful information in any communications with us
• Use the Website only for lawful purposes and in accordance with these Terms
• Not attempt to gain unauthorised access to any part of the Website or its underlying systems
• Not use the Website in any way that could harm, disable, or impair its operation
• Not submit information that is false, misleading, or that you do not have the right to share

All Content on this Website — including text, design, layout, and any other materials — is the property of Bunga Setia or its licensors and is protected by applicable intellectual property laws in Malaysia.

You may view and print Content from this Website for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any Content without our prior written consent.

The fees for our Services are set out in the relevant Engagement Agreement. Starting rates are published on our Website for indicative purposes only; the final fee for a matter depends on its complexity and the time required.

All fees are quoted and payable in Malaysian Ringgit (MYR). Payment terms are set out in the Engagement Agreement. We will not incur costs on a client's behalf without prior written agreement.

Fees are not refundable in respect of work already carried out. Where an engagement is terminated before completion, fees will be charged in proportion to the work completed at the time of termination.

The scope of any advisory engagement is agreed in the Engagement Agreement. Changes to the agreed scope require written agreement from both parties before additional work is undertaken.

We will use reasonable endeavours to meet any timelines discussed with you. However, the pace of legal proceedings and the conduct of third parties are not within our control, and we do not warrant that any particular timeline will be met.

Written summaries are provided following each advisory session as standard, at no additional charge. Advisory reports for estate-linked counsel engagements will be delivered within the timeframe set out in the Engagement Agreement.

To the fullest extent permitted by Malaysian law, Bunga Setia's liability to you in connection with the use of this Website (as opposed to the provision of Services under an Engagement Agreement) is limited to direct loss only and shall not exceed MYR 500.

We exclude all liability for indirect, consequential, or special losses arising from use of the Website, including but not limited to loss of data, loss of business, or reliance on information published on the Website.

Our liability in connection with Services provided under an Engagement Agreement is governed by the terms of that Agreement and our professional indemnity insurance coverage.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

Either party may terminate an advisory engagement at any time on reasonable written notice, subject to the terms of the Engagement Agreement. Termination does not affect any fees due for work already completed.

These Terms survive any termination of your use of the Website or of an engagement with us, in respect of those provisions that by their nature should continue to apply.

These Terms are governed by and shall be construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or from the use of this Website shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuching as the preferred seat.

Entire Agreement: These Terms, together with any applicable Engagement Agreement, constitute the entire agreement between you and Bunga Setia in relation to their subject matter.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.

Waiver: Our failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision.

Assignment: You may not assign any rights under these Terms without our prior written consent. We may assign our rights on reasonable notice to you.
